H.R. 4388, the PREP REPEAL Act, seeks to fully repeal Sections 319F–3 and 319F–4 of the Public Health Service Act.
These targeted sections are commonly referred to as the Public Readiness and Emergency Preparedness (PREP) Act, which currently grants pharmaceutical companies sweeping legal immunity for emergency use vaccines and other pandemic-related products.
This critical legislation would restore the fundamental right of Americans to pursue civil legal remedies when harmed by pandemic countermeasures—including Covid-19 shots—and eliminate the liability shields that have blocked accountability for the past 20 years.
The bill was introduced on July 15, 2025, by Rep. Thomas Massie (R-KY) and referred to the House Committee on Energy and Commerce.
“The PREP Act is medical malpractice martial law,” said Rep. Massie. “It prevents people from holding corporations accountable for the pain and suffering they cause during Presidentially declared emergencies. TALKING POINTS for calls and emails:
1. The PREP Act grants pharmaceutical companies near-total legal immunity, even for products that were fast-tracked or insufficiently tested. Repeal will reestablish accountability for negligence, fraud, or harm.
2. Thousands of Americans report severe injury or death from Covid-19 shots, yet have been denied justice under the PREP Act. H.R. 4388 would allow those cases—including current and pending appeals—to proceed in civil court.
3. The PREP Act shields liability for a broad range of products, including experimental drugs, PCR tests, and even masks. H.R. 4388 would restore legal remedy rights for all such countermeasures.
4. Pharmaceutical companies have made billions during public health emergencies, while ordinary citizens have borne the medical and financial risks. The repeal ends this one-sided system.
5. Legal immunity has contributed to medical coercion by removing consequences for harm. Restoring liability helps ensure informed consent is respected in practice, not just in theory.
6. The government’s Countermeasures Injury Compensation Program (CICP) denies the vast majority of claims and lacks transparency or due process. Americans deserve access to real courts and juries, not a bureaucratic black box.
7. The right to pursue legal redress is a cornerstone of the American justice system. H.R. 4388 ensures that this right is not suspended during a declared emergency, when dangerous products are most likely to be rushed to market.
