TALKING POINTS:
1. Amendment 141 removes Sections 10205–10207, which would provide a liability shield to pesticide manufacturers. These sections treat federally approved labels as legally sufficient warnings, even when independent science shows harm, making it significantly harder for injured individuals to seek justice.
2. Federal labeling does not guarantee safety and often lags behind current science. EPA approval is not a determination of long-term safety, and new research frequently emerges after products are already on the market.
3. The Farm Bill should not be used to override state authority or limit legal accountability. These provisions would undermine state level protections and prevent states from responding to emerging health and environmental risks.
4. Existing legal frameworks already address labeling and liability. There is no demonstrated need to grant special protections to pesticide manufacturers, and doing so would create an uneven legal standard favoring one industry.
5. This provision applies broadly across thousands of pesticide products used in agriculture, homes, schools, and public spaces. Its impact would extend far beyond farming and affect communities across the country.
WAPF will send out future alerts on the Farm Bill as events warrant.
