Oppose HPV Vaccines Administered by Dentists in New York!

New York lawmakers are considering two companion bills that would allow dentists to administer the human papillomavirus (HPV) vaccine.

A3892andS4548are dangerous because dentists lack the medical training necessary to safely evaluate patients for vaccine risks, contraindications, or medical history, and they are not equipped to manage adverse reactions. They are also unlikely to report vaccine-related adverse events to the Vaccine Adverse Event Reporting System (VAERS).

Allowing dentists to administer HPV vaccines undermines informed consent and trivializes the very real risks of vaccination, including injury and death.

Vaccines, like all pharmaceutical products, can cause serious side effects. The HPV vaccine, in particular, has been associated with hospitalizations, disabling conditions, and deaths, including adverse events in children and teens.

A large number of claims against Merck, the manufacturer of Gardasil, allege misrepresentation of safety and efficacy, fear-based marketing, and concealment of risk.

This legislation removes critical safeguards, places citizens at unnecessary risk and circumvents the traditional doctor-patient relationship.

A3892 was referred to the Assembly Higher Education Committee on 1/7/2026. S4548 passed the Senate on 2/3/26; referred to the Assembly Higher Education Committee on 2/3/26.

Please act TODAY and urge your legislators to OPPOSE A3892 and S4548.

HPV vaccines carry risks, including serious and potentially life-threatening side effects.

These bills put people at risk, bypass the doctor-patient relationship, and undermine informed consent.

Please protect families and oppose A3892 and S4548.

TALKING POINTS

1. Dentists do not have enough training about all the vaccines, risks, prescreening, contraindications, and emergency interventions for reactions, nor are they necessarily instructed on reporting reactions to the Vaccine Adverse Events Reporting System and on advising parents and patients about the statute of limitations and instructions for filing a claim with the National Vaccine Injury Compensation Program. 

2. When dentists are allowed to administer or prescribe vaccines, it diminishes the primary physician/patient relationship and removes critical health history screenings prior to vaccination. 

3. Dentists may not have lifesaving defibrillators as they do in doctors’ offices to save the lives of individuals who have an immediate life-threatening reaction to vaccines. Will dentists have the equipment and training to be able to tell the difference between cardiac arrest, anaphylaxis, and fainting and act accordingly to save the lives of individuals who react at the time of vaccination? 

4. Will dentists screen for allergic reactions to vaccine ingredients, such as checking for yeast allergies? Will they assess vaccine components, including checking for contraindications like fever, as stated in VIS statements? Are they knowledgeable about a person’s compromised immune system due to conditions like cancer, HIV/AIDS, or medical treatments (e.g., radiation, immunotherapy)? Additionally, will they screen for factors like easy bruising, bleeding tendencies, pregnancy, or aspirin intake and be informed about previous serious reactions to vaccines?

5. Vaccine Information Statements list many reasons why patients shouldn’t be vaccinated.  It is highly unlikely that dentists have the time to ask about all the reasons not to vaccinate them.   

6. Allowing dentists to administer vaccines without access to a person’s medical records means that a person may receive unintended or duplicate vaccines.

7. Vaccine package inserts warn of the risk of brain damage, life-threatening allergy, and death, and no one knows in advance whom a vaccine will harm. Pharmacists are not equipped to recognize nor handle serious adverse reactions.

8. According to VAERS (the federal Vaccine Adverse Event Reporting System), thousands of injuries related to the HPV vaccine have been reported, many in adolescents and young adults. Serious adverse reactions include neurological conditions, autoimmune disorders, and even death in some cases.

9. Vaccines are medical procedures that carry a risk of serious injury.  Hundreds of thousands have reported an adverse reaction to vaccination to the Vaccine Adverse Event Reporting System (VAERS). The U.S. Government has paid approximately $5.1 billion to victims of vaccine injury, according to VICP Data Reports.

10. Dentists will have no liability for the injuries and deaths caused by the vaccines they administer.  Vaccine administrators are shielded from liability for vaccine injuries and deaths through the combination of the law passed by Congress in 1986 establishing the National Vaccine Injury Compensation Program and the 2011 Supreme Court Decision BRUESEWITZ ET AL. v. WYETH LLC, FKA WYETH, INC., ET AL.
