Idaho lawmakers are considering legislation that would affirm a patient’s right to use their own blood or the blood of a designated donor for medical transfusions when medically appropriate and feasible.
H 528 protects the fundamental principle of medical autonomy and individual choice in healthcare decisions—especially in the context of blood products where some patients have personal, medical, or philosophical concerns about the source of donated blood.
The bill includes reasonable exceptions when the directed donation would be detrimental to the donor’s or patient’s health, when timing does not allow coordination, or in emergency services. It also provides liability protection for providers except in cases of gross negligence.
