The federal Farm Bill includes a dangerous pesticide liability shield in Section 10205 could be heading for a vote in the U.S. House today, April 29. The Massie amendment has been rejected but the Luna amendment is still alive and does the same thing.

This amendment is critical. It removes Sections 10205, 10206, and 10207—provisions that put public health, state authority, and clean water at risk.
OVERVIEW
Sections 10205, 10206, and 10207 of the Farm Bill work together to remove accountability from pesticide manufacturers, strip states of their ability to protect their communities, and weaken safeguards that protect our water.
Section 10205 grants sweeping immunity to pesticide manufacturers by treating EPA-approved labels as a complete legal defense, even in cases of serious harm. This applies to all pesticides regulated under FIFRA—more than 57,000 products—and future chemicals, eliminating incentives for companies to ensure safety or provide accurate warnings.
Section 10206 overrides state authority, preventing states and local communities from setting commonsense protections such as no-spray zones near schools, playgrounds, and sports fields. It removes existing protections and blocks future action at the local level.
Section 10207 weakens protections that prevent pesticide discharge into waterways, putting rivers, streams, and drinking water at risk.
The Luna Amendment removes these provisions and restores accountability, state authority, and basic environmental safeguards.

Dear Representative Meng,
I am writing to urge you, who are my Representative, to Vote Yes on the Luna Bill, so that pesticide makers will not escape being held liable for the harmful effects their pesticides cause to people eating foods that have been sprayed or treated with their Toxic products. They should not get a free “pass” when their products cause horrible side effects to those consumers who end up ingesting those toxic substances when they eat or come into contact with the TOXIC pesticides used on their foods. They must be held responsible for the toxic health effects caused by their products. Public Safety demands they be held responsible for the damage their products cause to innocent people.
